Landlords are bound to certain legal obligations when it comes to gas safety. A Landlords’ legal duties apply to a wide range of accommodation including:

  • Residential properties that are let by local authorities, housing associations, private sector landlords, housing co-operatives, hostels
  • Rooms let in bed-sit accommodation, private households, bed and breakfast accommodation and hotels
  • Rented holiday accommodation such as chalets, cottages, flats, caravans and narrow boats on inland waterways

What is the law for rental accommodation?

Any landlord letting a property that is equipped with a gas appliance you must understand and comply with the law relating to gas safety. If you let a property, you must make ensure the following:

  • Any pipe work leading to or inside the property, appliances and flues provided for tenants are maintained in a safe condition.
  • You must have a gas safety check every year.
  • A Gas Safe registered engineer must carry out the safety check in your properties in Great Britain and the Isle of Man.
  • You must give your tenants a copy of the gas safety certificate within 28 days of it being carried out or before they move in.
  • You are obliged to show your tenants how they can turn off the gas supply in the event of a gas leak.

When should I order a Gas Safety Certificate?

The Gas Safety Record must be presented to a tenant prior to them moving into the property to rent. It is advisable that you order the gas safety certificate at least 2 - 3 weeks before the tenancy start date. This is to ensure that time is given should the Gas Installer recommend mandatory work

Who carries out a Gas Safety Inspection?

Gas Safety Checks must be carried out by an engineer that is registered with the Gas Safe Register. The Engineer must be qualified to work on specific gas appliances and gas heating systems.

How do I know if my Gas Engineer is Gas Safe Registered?

You will be pleased to know that all of our preferred Gas Engineers are Gas Safety Registered and carry ID cards as proof of registration.

What Documentation do I need in respect of Gas Safety?

When a Gas Safety engineer visits a property, they will carry out a Gas Safety Inspection and later produce a Gas Safety Certificate or Gas Safety Record. The Gas Safe engineer will produce a standard Gas Safey Certificate which can be identifiable with a Gas Safe Register logo. The Gas Safety Record will also have the Engineers Gas Safe Identification number on it. The Gas Safety Certificate will also contain information such as: Property Address; The Gas Appliances in the Property and where they are located; The Date of the Inspection; Any Defects to the Gas Supply and any necessary remedial action.

What happens if the Gas Installation is unsafe?

If the Engineer considers that the Gas Installation or Gas Appliances are unsafe, he/she may choose to leave a warning notice for the landlord or in some cases, may disconnect the appliance. In this instance, you must seek to rectify any mandatory maintenance or repair on the appliances or installation.

Must I arrange a further Gas Safety Certificate after the repair recommendations are carried out?

If work is need on a Gas Appliance or to the gas installation, this will be noted on the Gas Safety Record. Once the work has been carried out, the paid invoices from the Engineer can be attached to the safety certificate to prove that the work has been carried out. This will prevent you from having to have a new Gas Safety Certificate.

When do I renew my Gas Safety Certificate?

Gas inspections must be carried out annually by a Gas Safe Registered engineer. A copy of the new Gas Safety Record must be given to the tenants within 28 days of the Gas Inspection.

Who Runs the Gas Safe Register?

Gas Safe Register is the official gas registration body for Great Britain (GB) and Isle of Man, appointed by the Health and Safety Executive (HSE) for Great Britain and HSWI for Isle of Man..

Gas Safe Register replaced CORGI as the gas registration body in GB on 1 April 2009. The HSE carried out a review of gas safety in 2006 which, after consultation with the gas industry, engineers and the public, led to the decision to change to a new gas registration scheme. The contract to run the new scheme was awarded to Capita and we launched Gas Safe Register. The sole focus of the register is on improving gas safety.
